Default Qisas [Retaliation] - what are they and how much blood money you gota pay?

:

Muhammad S Adly, Bulugh Al Maraam sharh talk NOTES.
Audios2

hudud

hadith no. 1009 bulugh al maram

100 camels or price of that = for a life killed [1 camel is like 1000$]

equal blood money for each thing available i.e. U only have 2 lips, if 1 removed = 50 camels.
10 fingers, if 1 removed = 10 camels.
1 complete cutting of nose = 100 camels, if cut half = 50 camels, if cut 1/3 then 33camels. 1 tooth = 5 camels.

If they don't agree to pay, then qisas [eye fo eye, life fo life etc]

hadith no. 1011.

3 persons worst on qiyamah; someone kill life in haram, fight and kill for revenge [of jahiliyah]. kil sm1 related to kila 4 revenge.

1012. Person killed by mistake i.e. someone hit other unintentionally and that caused deth. Blud money = 40 camels dat are pregnant [need to confirm again.]

1013 bukhari
RasoolAllah said these 2 fingers equal; pinky and thumb. Same applies to all teeth i.e. molar and any other tooth etc.

Aba dawud, tirmidhi sahih. Teeth equal and fingers equal and toes equal.

1014. Anyone who acts as doctor but not really trained for it, your responsible for blood money for any harm.

1015; amr ibn shu'ayb from his father - grandfather hadith. 5 camels for every wound on skin. wounded places on head and face, or qisas equal revenge. 5 camels for every cut [about 5000$]

1016; amr b. shu'ayb - fatha - g/father hadith? ahl al dhimah blud money fo murdr = 50camels i.e. half of mu'min due to them having no eman. Mu'ahid [asylum treaty for protection wit muslims] = 50 camels. i.e. finga ful cut = 5 camels, not 10 [like mu'min].

women equal to man in blood money except to issues 1/3 [30 camels] etc. (after that it doesn't rise except death = 100 camels). Amount different. Ahmad wa arba' kutub. Hasan

more info for this one;
http://ahlalhdeeth.com/vbe/showthread.php?t=735

[small explanation; diyya is not the price of the person, rather it is a financial compensation to the family whose member has been lost. This lost member could be financially responsible for the family and could even be the only financial supporter, so it is quite wise to make his [the males] diyya much higher than or double the diyya of someone who is not financially responsible.]

1017. 'Amr ibn Shu'ayb [same chain?]. Accidental involuntary killing = blood money. i.e. falling someone while asleep or chaos amongst muslims and death happened[?]

Unjust shave of total beard = 100 camels blood money or equal. 50 camels blood money if one eyebrow removed. Especially since haram to shave both?

every person responsible for their own actions i.e. son not responsible for father, nor father responsible for son etc.

or u can 4give them? [based on a talk i heard by waleed basyouni].

Well, I don't have camels :P . I guess the blood money can be paid in cash or other things now, right? for example, if the price of a camel is 100 dollars, then we can pay $100 x number of camels.?

Salam

yeah bro, the value has to be equal to - most likely - an average camel.

Allah knows best, but they're still expensive.

Bismillahir Rahmaanir Raheem,

as-Salaamu 'Alaykum Wa Rahmatullahi Wa Barakatuh.

I think this is a topic that alot of people, including some Muslims misunderstand.

Alot of people I met online think that Muslims just willy nilly go around and chop hands of, and don't know about the conditions and poverty and all that - once that is explained they realise that it's not that wierd after all.

"An ear for an ear, and the head is extra..."

Ibn Mas’ud was sitting on the chest of Abu Jahl, he cut off his head. It was

narrated that he then pierced a hole in Abu Jahl’s ear, tied a rope through it, and dragged his

head by this rope. It seems that Abu Jahl’s head was quite large, and Ibn Mas’ud was a frail,

weak person. So, when the Messenger of Allah (peace be upon him) saw Abu Jahl’s severed

head, he fell into prostration out of gratitude to Allah, and said: “By the One besides

Whom there is none worthy of worship, there is a Fir’awn for every ummah, and this

is the Fir’awn of this Ummah.”This is the narration in the ‘Sahihayn,’ and it is also said

that the Messenger of Allah (peace be upon him), after he saw the rope tied through the hole

in Abu Jahl’s ear, remembered the day that he had injured Ibn Mas’ud’s ear in Makkah, and

then said to Ibn Mas’ud: “An ear for an ear, and the head is extra.”

For the entire story of the killing of Abu Jahl, see ‘Fath al-Bari’ (7/342-354), and ‘Sharh Sahih Muslim’ (12/159-160).

The book from where this is taken from. Abdullah Azzam's advise for the youth.
