Default Fiqhul-Shar'i: Fiqh of Islamic Law

If anyone wishes to benefit with regard to usoolul-fiqh and maqaasid ash-shar'iyyah I beleive the best resource for all of us to benefit from is Dr. Nyazee's works.

the only minor issue about his backround is his hanafi orientation, however, his presentations are free from partisanship to his madhaab and presents a more comparative angle to it. The best part of his works is that it is a weapon against the kuffaric onslought of our religion and our shariah.

The most beneficial aspect of these works is that they cover a majority of our daily transactions from a legal societal aspect that most current day fiqh books lack.

Some of them don't require a password

the ones that do, the password is: nyazee

I can't upload them so I'll provide the link inshallah

Outlines of Islamic Jurisprudence (http://www.nyazee.org/islaw/theory/isloutpdf.zip)

Theories of Islamic Law (http://www.nyazee.org/islaw/theory/theories.zip)

General Principles of Criminal Law (http://www.nyazee.org/islaw/criminal/crimprin.zip)

Islamic Law of Business Organizations: Parterships (http://www.nyazee.org/islaw/busorg/partship.zip)

Islamic Law of Business Organization: Corperations (http://www.nyazee.org/islaw/busorg/islcorp.zip)

Child Rights in Light of the CRC and Islamic Law (http://www.nyazee.org/islaw/misc/crc-art2.rar)

Human Rights in Islamic Law (http://www.nyazee.org/islaw/misc/hr-art3.rar)

Bibliography of Islamic Law: Original Sources (http://www.nyazee.org/islaw/biblio/islbib.zip)

Exercises in Interpretation:

Excercise No. 1: The Verse Dealing with the Offence of Qadhf (False Accusation of Unlawful Sexual Intercourse) (http://www.nyazee.org/islaw/exercises/ex1.pdf)

Exercise No. 2: The Offence of Zina (Unlawful Sexual Intercourse) (http://www.nyazee.org/islaw/exercises/ex2.pdf)

Exercise No. 4: Grave and Sudden Provocation in Islamic Law (http://www.nyazee.org/islaw/exercises/ex3.pdf)

As you can see the material is geared towards the shar'i aspects of legislation rather than the common fiqh manuals most of which are geared towards ibaadaat.

This is the main site of Dr. Nyazee
Islamic Law Infobase
all shar'i related

The author also fully translated the work of Ibn Rushd Bidayatul-Mujtahid wan-Nihaayatul-Muqtasid which is in two volumes

here is what the book looks like

Amazon.com: The Distinguished Jurist's Primer Volume I: Ibn Rushd, Imran Ahsan Khan Nyazee: Books

but order it from a Muslim site like kitaabun.

Kitaabun - Classical and Contemporary Muslim and Islamic Books: Bidayat al-Mujtahid:] The Distinguished Jurist's Primer- PB Set

the only thing i worry is that average people like us who would by it and automatically think, by default of their having the book, that they are jurist or qualified to speak about this. While it is truely a primer for the aspiring jurist, it is nothing more but an aquintance for the average person to know the details of what a qadhi (muslim judge) must go through. It is detailed case law almost a reflection of how works on western law are deduced. It is a matserpiece and I think it is the bets book for people to study law in a juristic framework.
